On political persecution and opposition in Ukraine

We – the members and volunteers of the “Uspіshna Kraina” political party – publicly and in accordance with the right given by the Constitution claim on obstruction of our operation by the Ministry of Justice of Ukraine and Pavlo Petrenko individually for political reasons.

By orders from above, officials of the Ministry of Justice cynically took advantage of official position and authority and refused to accept new changes in the program of the “Uspіshna Kraina” party, as well as in a part of the party leadership.  This data was changed in public (in the manner prescribed by law), it was supported by the majority of party members during the 8th Extraordinary Congress of the Party on December 12, 2015.

We recall that during this Congress, in accordance with the Charter of the Party and the procedure prescribed by the Law, Oleksandr Klymenko has been chosen as the honorary head of the party, Dedusheva Marina Vladimirovna became the head of the party. In addition, during the Congress it was adopted a party program with the basic message: “From chaos – to order, from the order – to success.”

Oleksandr Klymenko took the floor in front of delegates from all Ukrainian regions  and stated that it is time to stop the chaos and create an order in the country, Ukraine should find its own way and follow its own values”. He called for “cooperation instead of conflict, trade instead war, limiting pragmatism instead of populist utopias”. Full speech and video are here.

We believe that the Ministry of Justice in the person of Pavel Petrenko is committing a criminal offense. It is committed by the hands of simple officials, who will be punished for it in future. Since the actions of the Ministry of Justice are direct violation of the Constitution, which guarantees freedom of political activity and the equality of all parties before the law. In addition, the Ministry of Justice violates the provisions of the Law “On Political Parties in Ukraine”: «Bodies of state authority and local self-government and their officials shall be prohibited to discriminate against certain political parties or grant them privileges, and nor shall they assist political parties unless otherwise provided by law».

Motives of such actions are clear. In particular, it comes about elimination of political rivals to current government in the country. They want to eliminate real political force, which is not a pocket opposition. It is not only criticizing the government, but has an alternative point of view on course of events in the country. It is ready to implement offered program of changes!

We declare that information in the “legal conclusions” of the Ministry of Justice concerning the fact that Oleksandr Klymenko, the honorary head of the party, is allegedly a member of the governing bodies of the party organization Agrarian Party of Ukraine in Golovanevskiy region, is completely absurd and does not correspond to reality. In order to confirm groundlessness of these statements, lawyers of the party have already sent a formal request to the Ministry of Justice and the Agrarian Party of Ukraine.

In addition, we would like to emphasize that, according to the Charter of the “Uspіshna Kraina” party, which was approved by the Order of the Ministry of Justice of Ukraine №2667/5, December 21, 2015, the honorary chairman is elected and operates in accordance with the Charter of the “Uspіshna Kraina” party. No approvals of the candidacy of an honorary head of the party on the part from the Ministry of Justice are required (in accordance with current legislation of Ukraine).

Thus, we consider the actions of the Ministry of Justice of Ukraine and the Minister Petrenko to be politically motivated. We intend to sue it in Ukrainian courts (if necessary in international courts).

We also claim that these actions of the authorities will not have impact on our position. We are not going to give up. We can not be intimidated. The “Uspishna Kraina” party continues its work. We are proceeding to be the voice of those Ukrainians,  who are not heard today.  Our voice becomes stronger and louder every day!
